CHILDREN’S PRIVACY POLICY OF MY LITTLE PEARLS LLC

Set forth below is our Children’s Privacy Policy. Our Children’s PrivacyPolicy explains how we collect, use, share and protect the information which is provided to us as a result of the establishment of an Account with us by a person who is under the age of 13.

We have designed the APP to be useable and enjoyable for persons under the age of 13. As described below, a person who is under the age of 13 cannot establish an Account by themselves. Only the parent or guardian of such person can set it up for them.

Such parent or guardian is encouraged to read and discuss this Children’s Privacy Policy with such child under the age of 13. References below to “you” or “your” refer to a child under the age of 13 unless the context suggests otherwise.

“Account” means an account established by you with use after the APP has been downloaded.

“APP” means the application which is owned by us and which enables any mobile phone user to post Photos/Videos (for the public) or send Photos/Videos (by private message) regarding one or more messages to other persons who have access to the APP.

“Posting” means your posting of Photos/Videos through the use of the APP.

“Photos/Videos” means the content which is part of your Posting.

THE CHILDREN’S ONLINE PRIVACY PROTECTION ACT

We are committed to complying with the Children’s Online Privacy Act (“COPPA”). COPPA is a federal (U.S.) law which is designed to protect children when they are involved with online activities including the use of an app, such as the APP. We encourage each parent or guardian of a child under the age of 13 to take an active role in protecting their child’s privacy and online activity.

PROCEDURE FOR ESTABLISHING AN ACCOUNT – CHILD UNDER AGE 13

After parent or legal guardian downloads the APP and creates an account for themselves, they can go to their Profile > Settings and choose the Linked accounts option. If they choose to Add another account, they will need to register an account for their child, select their birth date (which can be in the future if the child is not born yet, in which case they will be able to edit the birth date once after birth) and give their explicit consent for the account creation –  mandatory step. Once they finish up the account creation process for their child, the accounts follow each other and the parent or legal guardian will always have access to their child’s account, in Profile > Settings > Linked accounts.

PARENTAL ACCESS

A parent or guardian who has already given us permission to collect and use his or her child’s personal information can, at any time, do the following: (1) review, correct, or delete the child’s personal information; and/or (2) terminate the Account from the app.

THE DATA WE COLLECT

For persons under the age of 13 whose parent or guardian has consented to the establishment of the Account, the user name (created by the parent/legal guardian), the password (created by the parent/legal guardian) and the e-mail will be required in order to establish your Account.

In addition to the date of birth and the consent, this is the information which we collect. Once an Account was established, subsequent use of the APP will require the sign-in with the user name and password.

ONLINE TRACKING – DO NOT TRACK

We do not track your location or your specific use of the APP.

USE OF YOUR INFORMATION

We currently do not share, rent or sell your personal information. We use Google Analytics to gather data regarding the use of the APP. The Google Analytics platform shows the aggregate, high level usage data as it relates to engagement, retention and acquisition. We do not store individual tracking information per Account holder.

INDIVIDUAL USE AND ACCESS

If you want to do a Posting, a “Create” feature will ask you whether your Posting is to be “Private”, “Only me”, “Following” or “Public”.

A Private Posting of Video Content will only be available for viewing by the recipient/s whom you have selected. An Account holder who sends a Private Posting does not have the option of permitting you to share such Private Posting as a Public Posting. A Public Posting Of Video Content will be available for viewing by all persons who have an Account.

SECURITY SAFEGUARDS

We use encryption. Transmission of data is sent through industry standard SSL encryption over HTTPS. Data is housed in secure storage behind industry standard firewalls and access control policies. Please be aware that no security measures or safeguards are perfect or impenetrable. If you have any reason to believe that your personal information is not secured, please contact us by e-mail as discussed below.

CHANGES TO THIS CHILDREN’S PRIVACY POLICY

We reserve the right in our sole discretion to modify this Children’s Privacy Policy. Such changes can be made at any time by posting any such modification within this Children’s Privacy Policy.

As you continue to use the Website after we have posted the modification, you will be agreeing – without action on your part – with the terms of the Children’s Privacy Policy as so modified. You remain free at any time to cease using the APP and/or cancel your Account.
